1. Introduction

Welcome to JustCountIt ("we," "our," or "us"). By accessing or using our website, mobile application, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

2. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

When you purchase a subscription through JustCountIt, you are also entering into an agreement with Paddle. Please review Paddle's Buyer Terms and Conditions.

3. Use of Service

JustCountIt provides AI-powered nutrition tracking and weight prediction services. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Service for your personal, non-commercial use.

Acceptable Use

You agree not to:

Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
Harass, threaten, demean, embarrass, or otherwise harm any other user of the Service.
Violate, or encourage others to violate, any right of a third party, including by infringing or misappropriating any third-party intellectual property right.
Interfere with security-related features of the Service.

4. Subscriptions and billing

Certain features of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the type of subscription plan you select.

Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it.
Cancellation: You may cancel your subscription renewal either through your online account management page or by contacting our customer support team.
Refunds: Refunds are governed by our Refund Policy.

5. No Medical Advice

IMPORTANT: The Service is for informational purposes only. The AI predictions, nutritional analysis, and weight forecasts are estimates and should not be treated as medical advice. We are not medical professionals. You should consult with a physician or other healthcare professional before starting any diet or exercise program.

6. User Accounts

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall JustCountIt, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.

9. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
